CIVIL PENALTIES
The intentional improper disposal of hazardous materials is illegal and the consequences severe. Sonoma State University, as a potentially liable property owner, investigates all suspected hazardous materials incidents. Investigations include sampling, photos, and filing reports with the Sonoma County Public Health Department and other state and federal agencies. Those persons suspected of illegal disposal will be prosecuted under Penal Code Section 374.8 in order to recover fines, clean up costs, and related damages.
SSU will take every action necessary to recover these costs and identify the individuals responsible for these activities. California Penal Code Section 374.8 states that "Any person who knowingly causes any hazardous substance to be deposited on any road, street, highway, alley or any land of another . . . is punishable by prison in county jail for not more than one year, or a fine of not less than $50 and not more than $10,000 or by both fine and imprisonment."
INFORMANT REWARDS
Sonoma State University encourages everyone in the campus community to be aware of potentially illegal hazardous materials disposal. If you are witness to any dumping or abandonment of hazardous materials, obtain as much information on the individual and circumstances as possible and contact Human Services/Environmental Health and Safety, extension 4003 during business hours, or call the University Police at x2143 after hours.
Rewards up to $5000 are available to any person who provides information which materially contributes to the imposition of a civil penalty or criminal fine [Health & Safety Code 25191.7]. The California Department of Toxic Substances Control (DTSC) is responsible for administering the informant reward system.
